Applicant, Wizards of the Coast LLC, a subsidiary of Hasbro, Inc., is a large corporation in the hobby gaming business, and the owner of the DUNGEONS & DRAGONS® role playing game and MAGIC: THE GATHERING® trading card game. Applicant intends to use, and in fact has started using, THEROS as the name of a new expansion set of its MAGIC: THE GATHERING® trading card game, including an online version of the game. (See Exhibit 1 consisting of Wizards' press release regarding the anticipated September 2013 release of the THEROS expansion set.) Wizards also intends to expand its use from the core physical and online trading card game to encompass tournaments, online publications, movies and television, computer games, games for mobile digital devices and the other goods and services encompassed in its applications. While there may not be a commonly recognized meaning of the word "theros," it is clearly Greek in origin, and generally means "summer." It is often used as a given name (not surname) for boys. (See Exhibits 2 - 4 for web references indicating the Greek origin and meaning of "Theros" and its use as a given name.) Applicant chose THEROS as the trademark for the new MAGIC: THE GATHERING® expansion set for its association with Greece and Greek mythology. As set out in the accompanying Wikipedia article (Exhibit 5), in Greek mythology "Theros" is one of the "Horae" or goddesses representing the seasons. In addition to being the name of and trademark for the expansion set of MAGIC: THE GATHERING® cards (as well as the name of the first of the three "blocks" of cards within the set), Applicant also uses THEROS as the name of the fantasy world within which the game is set. Applicant does not, however, use THEROS as the name of any character associated with the set of cards.
